1. Acceptance of Terms

By downloading, accessing, or using the DeamScan mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Legal Agreement: These Terms constitute a legally binding agreement between you and DeamScan Technologies ("Company," "we," "our," or "us").

2. Description of Service

DeamScan is an AI-powered skincare analysis application that:

• Analyzes facial photos using artificial intelligence
• Provides skincare recommendations and insights
• Helps locate nearby dermatology clinics
• Tracks skin analysis history

NOT A MEDICAL DEVICE: DeamScan is NOT a medical device, diagnostic tool, or substitute for professional medical advice.

3. Medical Disclaimer

NO MEDICAL DIAGNOSIS: DeamScan does NOT provide:

• Medical diagnosis
• Treatment recommendations
• Professional medical advice
• Prescription recommendations
• Emergency medical services

FOR INFORMATIONAL PURPOSES ONLY: All analysis results, recommendations, and information provided by DeamScan are:

• For educational and informational purposes only
• Based on AI analysis, which may not be accurate
• Not a substitute for professional medical advice
• Not reviewed or approved by dermatologists or medical professionals

CONSULT A PROFESSIONAL: Always consult a qualified healthcare provider or licensed dermatologist for:

• Diagnosis of skin conditions
• Treatment plans
• Medical concerns
• Unusual skin changes
• Any health-related decisions

EMERGENCY: In case of medical emergency, call 911 (US) or your local emergency number immediately.

4. User Eligibility

Age Requirements

• Minimum Age: 12 years old
• Under 18: Requires parental/guardian consent and supervision
• Parental Responsibility: Parents/guardians are responsible for minors' use of the App

Account Requirements

• Must provide accurate, complete information
• Must maintain account security
• One account per person
• Must not share account credentials

5. User Account

Account Creation

You may create an account using:

• Email and password
• Google Sign-In
• Apple Sign-In

You are responsible for maintaining account security. You must notify us immediately of unauthorized access.

Account Termination

• By You: You may delete your account anytime in Settings
• By Us: We may suspend/terminate accounts that violate these Terms
• Effect: Upon termination, all data will be deleted within 30 days

6. Subscription & Payment

Free Features

• 2 free skin analyses
• Basic app features
• Limited analysis history

Premium Subscription

• Pricing: Displayed in-app (varies by region)
• Billing Cycle: Monthly or Annual
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Payment: Processed through Apple App Store or Google Play Store
• Taxes: Applicable taxes may apply based on your location

Cancellation & Refunds

• Cancellation: Cancel anytime through your Apple/Google account settings
• No Refunds: Payments are non-refundable except as required by law
• Effective Date: Cancellation takes effect at end of current billing period
• Free Trial: If offered, will be forfeited upon purchase

Price Changes

• We reserve the right to change subscription prices
• You will be notified 30 days before any price increase
• Continued use after price change constitutes acceptance

7. User Content & Photos

Your Photos

Ownership: You retain ownership of all photos you upload.

License: By uploading photos, you grant us a license to:

• Process photos through our AI analysis
• Store photos in your account
• Use photos to improve our AI (anonymized, aggregated data only)

Restrictions: Do not upload:

• Photos of minors without parental consent
• Photos of other people without their consent
• Inappropriate, illegal, or offensive content

Photo Usage

• AI Processing: Photos are sent to OpenAI for analysis
• Storage: Photos stored securely in Firebase/Firestore
• Deletion: You can delete photos anytime
• Privacy: Photos are NOT shared with third parties except as stated in Privacy Policy

8. Acceptable Use

You MUST NOT:

• Use the App for illegal purposes
• Attempt to hack, reverse engineer, or compromise the App
• Upload malicious software or code
• Impersonate others or provide false information
• Harass, abuse, or harm other users
• Scrape, mine, or collect data from the App
• Use the App if you're a competitor
• Violate any laws or regulations
• Share your account credentials
• Use automated tools or bots

Consequences

Violation of these terms may result in:

• Account suspension or termination
• Legal action
• Reporting to law enforcement

9. Intellectual Property

Our Rights

• Trademarks: "DeamScan," logos, and branding are our property
• Copyright: App design, code, content, and AI models are protected
• Patents: Technology may be patent-pending or patented

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Use the App for personal, non-commercial purposes

Restrictions

• Reverse engineer or decompile the App
• Remove copyright or proprietary notices

10. AI Analysis & Accuracy

No Guarantee

• AI Limitations: AI analysis may not be accurate or reliable
• No Warranty: We do not guarantee accuracy, completeness, or reliability
• Educational: Results are for educational purposes only
• Variables: Results may vary based on photo quality, lighting, etc.

Your Responsibility

• Photo Quality: Ensure good lighting and clear photos
• Accurate Information: Provide accurate personal information
• Professional Advice: Consult professionals for actual diagnosis

11. Third-Party Services

We integrate with:

• Firebase/Google: Authentication, database, analytics
• OpenAI: AI-powered analysis
• Google Maps: Location services
• RevenueCat: Subscription management
• Apple/Google: Payment processing

Third-Party Terms: You must also comply with third-party terms of service.

No Liability: We are not responsible for third-party services, their downtime, or changes.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or errors
• AI analysis inaccuracy
• Medical decisions based on App results
• Third-party actions or services
• Loss of photos or data

MAXIMUM LIABILITY

Our total liability shall not exceed the amount you paid for subscriptions in the last 12 months, or $100 USD, whichever is less.

15. Indemnification

You agree to indemnify, defend, and hold harmless DeamScan Technologies, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of third-party rights
• Your use or misuse of the App
• Your content or photos
• Medical decisions made based on App results

16. Changes to Terms

Modifications

We may modify these Terms at any time by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending email notification (for material changes)

Acceptance

Continued use after changes constitutes acceptance of modified Terms.

Objection

If you object to changes, your sole remedy is to stop using the App and delete your account.

17. Termination

By You

• Delete your account in Settings anytime
• Data will be deleted within 30 days

By Us

We may terminate or suspend access immediately, without notice, for:

• Violation of these Terms
• Illegal activity
• Fraud or abuse
• At our discretion

Effect of Termination

• Access to App will be revoked
• All licenses granted to you will terminate
• Outstanding payments remain due
• Provisions that should survive (privacy, liability, etc.) will survive
